The Court of Appeal in Warsaw, 5^th Civil Division, composed of:

having examined on 11^th February 2021 in Warsaw at a session in camera the case brought by the Municipal Consumer Ombudsman in O. against Bank (…) Joint-Stock Company in W. for payment

as a result of the complaint of both parties against the decision of the Regional Court in Warsaw dated 1^st April 2020, ref. no. IV C 1348/19,

decides to:

1. amend the complained decision in part so as to grant the status of subgroup member No. 164 to M. S. and deny the status of member of subgroup No. 194 to M. S.;
2. dismiss the defendant’s complaint;
3. leave the decision on the costs of the complaint proceedings to the Court of first instance in the decision concluding the case.
