LEGISLATIVE PROCESS: Parliamentary Committees have completed work on the draft act implementing the directive on representative actions

The legislative process relating to the governmental draft act amending the Act on Pursuing Claims in Group Proceedings and certain other acts (print no. 437) is not slowing down despite the holiday period.

On 26 June 2024, the Sejm of the Republic of Poland referred the governmental draft act amending the Act on Pursuing Claims in Group Proceedings and certain other acts (print no. 437) to the Committee on Economy and Development and the Committee on Justice and Human Rights.

The Committees mentioned above completed their work on 11 July 2024, and in the report, a motion was submitted for the Sejm of the Republic of Poland to pass the draft act. During the work in the Committees, no substantive changes were introduced to the draft act, only the text was corrected following the principles of legislation – some editorial units were merged, in others the word order was changed, or minor linguistic changes were introduced that did not change the substantive meaning of the proposed solutions.

The governmental draft (print no. 437) is to implement into the Polish legal order the Directive (EU) 2020/1828 of the European Parliament and of the Council of 25 November 2020 on representative actions for the protection of the collective interests of consumers and repealing Directive 2009/22/EC – the so-called directive on representative actions (hereinafter: “Directive 2020/1828” or “RAD”).
