Brochure – Changes in group proceedings – Implementation of Directive 2020/1828 on representative actions – opportunities for consumers, risks for enterpreneurs

A government bill to amend the Act on pursuing claims in group proceedings and certain other acts (Printing No. 437), which is to implement into the Polish legal system Directive (EU) 2020/1828 of the European Parliament and of the Council of 25^th November 2020 on representative actions for the protection of the collective interests of consumers and repealing Directive 2009/22/EC – the so-called Directive on Representative Actions (hereinafter: “Directive 2020/1828” or “DRA”) – is already in the Polish Parliament and its first reading was held on 27^th June 2024.

We encourage you to read the brochure “Zmiany w postępowaniu grupowym – Implementacja Dyrektywy 2020/1828 o powództwach przedstawicielskich – szanse dla konsumentów, ryzyka dla przedsiębiorców”, in which we introduce the assumptions of the drafted legislation, primarily from the perspective of issues relevant to enterpreneurs.

In the brochure, we present the most interesting and relevant issues, with examples, in 20 questions and answers.

The brochure was prepared based on the draft that was submitted to the Polish Parliament. We also encourage you to follow the posts on our blog, in which we report on the progress of legislative work and analyze further proposals for the wording of new regulations implementing Directive 2020/1828.
