Implementation of Directive 2020/1828
Implementing act Directive 2020/1828 has been implemented through amendments to the Consumer Protection Law and the Code of Civil Procedure, enacted on 14th August 2023; the new regulations came into force on 15th October 2023.

Qualified entity to bring an action Organizations or associations involved in consumer protection for at least 12 months.

If an organization wishes to obtain the status of a qualified entity, either permanently or in relation to a specific claim (ad hoc), it should first submit an application to the Consumer Rights Protection Center.

Third-party funding Admissible; cannot take place in conflict of interest; the third party cannot influence the actions of the qualified entity.
Facilities for consumers A collective redress mechanism dedicated specifically to consumers has been established for the first time. Consumers do not bear the costs of the proceedings, unless the additional costs are due to their intentional acts or negligence.
Other comments Before bringing the case to court, the competent institution shall address the entrepreneur with a claim and a warning that legal action will be taken if the entrepreneur fails to comply with the terms of the settlement.
