The settlement is subject to review and approval by the court, which must take into account the interests of the parties, in particular those of the consumers concerned. Consumers may submit statements refusing to be bound by the settlement within the time limit set by the court.Individual consumers covered by a representative action for compensation and/or remedies shall not bear any costs of the proceedings. Exceptionally, a consumer may be charged for costs incurred as a result of their intentional or negligent conduct.
The state may provide financial support to organizations for specific representative actions. |
Other comments |
Before bringing an action, the qualified entity must consult with the potential defendant, calling for the cessation of infringements. The obligation to consult in advance may be waived in cases where the qualified entity, at its discretion, considers that the circumstances are such that legal proceedings must be continued without delay.
Qualified entities may require interested consumers to pay a limited registration fee or similar fee. |
