Statement of claim for damages to compensate the losses of the group members – clients of the developer, Firma Inwestycyjna Leopard – who entered into agreements on the establishment of separate ownership of premises, sales agreements, and loan agreements concerning residential units located on al. Kijowska in Kraków. The losses arose as a result of actions by the defendant and the developer, which bore the characteristics of a tort, including, among others: the defendant’s conclusion of an agreement with the developer concerning the issuance of bonds by the developer (purportedly to finance the investment), despite the fact that the developer had no realistic chance of fulfilling its obligations under the above agreements from the outset; and the submission to group members of proposals to make additional payments for the units under the threat of the developer’s bankruptcy.
