A lawsuit filed by a group of consumer borrowers against TF Bank AB S.A. Branch in Poland in Gdańsk, represented by the Financial Ombudsman.
The Financial Ombudsman, acting as a group representative for the first time in history, filed a lawsuit against TF Bank AB S.A. Branch in Poland in Gdańsk for the invalidation of consumer loan agreements granted to group members by the Bank for the purchase of heat pumps (offered by two companies from Toruń and Kościan) This was due to the Bank’s use of unfair market practices between 2001 and 2022, which consisted of misleading borrowers who were members of the group as to the date and method of disbursement of the loan, and then disbursing the loan funds to the sellers without verifying whether the heat pumps had been delivered and installed to the customers. This resulted in consumers who were members of the group being left with loans to repay, even though they did not receive the heat pumps they had ordered, because in the meantime their sellers had declared bankruptcy or ceased trading.
